Rep. Parente has filed a bill to allow boards of health use of the Non-Criminal Enforcement (G.L.c.40, §21D) without first going to town meeting for approval through adoption of an omnibus bylaw that lists the town bylaws and regulations that are subject to §21D enforcement. It is a cumbersome process that is often difficult for local health departments to accomplish.
The law allows a municipality to issue a ticket similar to a parking ticket to violators, with fines not to exceed $300. Penalties collected under §21D go to the Town.
